Trust creation and administration

Trusts can be setup with as much flexibility or rigidity as required by the settlor of the trust. The trust deed sets out the purposes of the trust, how the trust will be managed and the requirements or limits on Mdina Trust Services Limited as trustees. Thus each trust is the result of a specific discussion with the client who intends to settle funds or property into the trust, leading to a customized solution that achieves the objectives intended for the beneficiaries of the trust.

The settlor may choose a co-trustee to have equal responsibility and power as Mdina Trust Services, and possibly be more directly involved in the management of certain assets where specialized and more intense attention is desired. Under Maltese law, the settlor may also be a beneficiary of the trust. Additionally, a protector may be appointed to appoint or remove trustees and oversee certain trustees' actions to protect the beneficiaries' interests.

Mdina Trust Services Limited has experience in the corporate and investment administration and is able to manage trust assets either directly or in an oversight capacity when specialized outside advisors are engaged. Third party advisors, custodians or investment managers may be hired either as agreed upon in the trust deed or as exigencies require with the trustees fulfilling their duty to act prudently in the interests of the beneficiaries. Regular reports, and if required externally audited reports, on the status and performance of the trust will be provided as agreed to in the trust deed.
